I think there is/can be a lot of difference. It depends on what you do with the lines.

If you just build from the lines taken, its still theft. If you alter the lines, maybe combines the shapes of two different kayaks, I think its OK.
Also, I have taken lines of a kayak that is no longer in production. Im not sure how that leaves you legally, but for personal use I think its OK.

Guess I think its OK if the outcome is a kayak that you cant get any other way.

My thoughts, maybe someone is more knowledgable in the legal aspects
